Terms of Service

These terms govern your use of KiddoCapture ("the Service"), operated from Melbourne, Australia. By creating an account or using the Service, you agree to these terms on behalf of the company you represent ("you", "your company").

1. The Service

KiddoCapture provides workflow software for childcare photography companies: roster management, photo-day checklists, group photo tagging, parent registration, centre communication tools and optional add-on modules. We may improve, add or retire features over time; we won't materially reduce the core service you pay for without notice.

2. Accounts

One subscription covers one company. You're responsible for the accounts you create for your team, for keeping credentials secure, and for everything done under your company's accounts. Accounts may not be shared between companies.

3. Free trial

New companies receive a 30-day free trial with all features and add-ons enabled, on unlimited centres. No payment details are required to start a trial. At the end of the trial, continued use requires an active paid subscription.

6. Acceptable use

You agree not to: use the Service for anything unlawful; attempt to access another company's data; resell or sublicense the Service without our written agreement; probe, disrupt or overload the Service; or upload malicious code. We may suspend accounts that put other customers' data or the platform at risk.

7. Third-party integrations

Optional integrations (such as Netlife PhotoSuite) connect the Service to systems we don't control. You're responsible for your accounts on those systems, and we're not liable for their availability or behaviour.

8. Availability and support

We work to keep the Service available and fast, but we don't promise uninterrupted operation. Planned maintenance is scheduled outside Australian business hours where possible. Support is provided by email; Pro subscribers receive priority response.

9. Liability

To the maximum extent permitted by law (including the Australian Consumer Law, whose guarantees are not excluded), our total liability for any claim relating to the Service is limited to the amount you paid us in the 3 months before the claim arose. We're not liable for indirect or consequential loss, including loss arising from missed photographs or data entered incorrectly.

10. Termination

You can cancel at any time from within the Service or by contacting us. We may terminate with 30 days' notice, or immediately for material breach of these terms. Sections 5, 9 and 11 survive termination.

11. General

These terms are governed by the laws of Victoria, Australia. If any part is unenforceable, the rest stands. We may update these terms with notice to subscribed customers; continued use after the effective date constitutes acceptance.
